So, no, despite what you think Noah, it IS actuall illegal to make 'his own version' of the painting if they weren't given express permission by the original artist (in the same way that you're not allowed to make/release a remix without permission from the copyright owners, which is why most remixes are bootlegs/white-label/Unknown Artist productions)

Screwhead: I'm not sure those rules apply to art... We should ask someone... I don't think it does... If I draw a picture of a house on a lake, I'm sure you can draw a picture of a house on a lake without problems... As long as they are not duplicates, there is nothing wrong with that.

They apply to anything that can be copyrighted as an artistic expression: paintings, drawings, movies, plays, novels, articles.. Technically, us reposting the content of news articles and not just linking to them is breaking copyright law, as is your server downloading/saving pictures linked from other sites. If someone wanted to be a dick about it, they could very much sue you for each individual image you're re-hosting without permission.

For your house on a lake example... If you draw a picture of a house on a lake, and I go to the same place and draw the same house on a lake, that's not really a problem.

If you publish/copyright the drawing, then yes, it would be illegal for me to 're-create' the drawing, even if it's not based on your drawing specifically and I just happen to sit at the same spot and find it nice enough to draw.

D'ailleur, l'originalité en art est un concept plustot moderne.

A part ca, qui parmis les artistes psychadeliques n'a pas repris Alex Gray, d'une facon ou un autre.

I think you would get laughed out of court if you went after someone who drew the same house on a lake but totally differently cause you claim you own that image. You have to stop looking on American law. It works differently here in Canada... That is why we don't sue each other like crazy, cause we can't.

It's one thing to copy as a means to understand and learn the techniques. In these cases, people will give credit to those they've been inspired by.
It's something completely different to take someones work, and pass it off as your own, or without giving credit where credit is due.

databoy, les égyptien usaient de peinture a base de pigments primaires (cailloux, algues, etc) pour faire des hyérogliphes--> forme d'art ? ou caligraphie? la caligraphie est-elle artistique?

ya les médium artistiques (émotionnel, cérébral) et les médiums créatifs (peinture, gouache, bois, pierre, etc).

les hommes de cavernes, comme la muse de thalès, c'est d'la marde question art. D'ailleurs si tu as étudié un peu l'histoire de cette matière, sache que les 2watts dans l'fond d'la grotte ne prétendait pas usé d'un médium artistique (canalisation cérébrale ou émotionnelle) il usait plutot le médium créatif (grotte, bois-brulé) pour expliqué a la tribus de retard comment il allait capturé le gibier.

Or dans cette dualité - création/artistique - le concept rebute souvent à la pratique.
