if you produce a workform of art. the whole medium is considered and how publication of the piece itself. copyright is taken as "whole" being if you release something that has the same function and occupy the same place in what it has being released for. now taking a backdrop, wich isnt copyrighted in the first place, and having an other backdrop that has similarity to its contents shapes ,isnt an undeniable copy/replacement. 1) it would have to be copyrighted in the first place. 2) you can only copyright a buizness name. as for copyright of ownership. as for copyright of creating something new. having a drawing can prevent other ppl from releasing an other paper, containing their own art. ie - YOU WOULD HAVE TO HAVE ROCK SOLID ARGUMENTS THAT ARE VOIDING ALL BELEIFS THAT THIS MIGHT HAD BEING MADE ALONE , WITHOUT INTENTION TO COPY OR MADE DUPLICATE. 3) its hard enought to copyright technology, good luck defending your kids drawing. 4) artist has to be renownd. ---- but honestly, this fails in court, i have much publications here on intellectual properties. that i can assert this is a total failiure at calling this a copy. >>>>.<<<< DOT ! |
