The field or industry doesn't affect employee rights unless otherwise specified in the contract (if any) at the time the employee is hired. Most people don't know their rights, don't care, or are easily intimidated by their employers and losing their pseudo-dependant jobs which is why alot of people get exploited, mistreated, overworked, or neglected when it comes to fringe benefits that the company offers to certain employees which they're usually, and should be entitled to (ie: company shares, medical beenfits, regular annual raises, overtime pay if applicable, vacation pay, paid sick days, etc.) I know alot of people, some of who are close friends of mine who are constantly being taken advantage of by their emplyers cause they feel trapped, don't understand their legal rights as an employee in the work force, or apathetically neglect to realize that they could work elsewhere doing the same thing for someone who wont mistreat, abuse, exploit them. Despite my continued efforts to help them build up the courage to stand up for themselves some of them are actually convinced that they're content with their jobs or don't have the confidence to confront their bosses with the alternative statement: "Unless you show more appreciation for my work and increase my wage accordingly, I'll be giving you my two week notice shortly and start working for your competition."

Speaking from my own experience employees should have a mutual respect and a mutual understanding with their employer regarding discourse or the terms and condition of the work being done. If such an accomidation cannot be made on the first day of work than one needs to ask themselves whether they're best off compromising their own financial, social, and psychological security working for someone who, reflective of the way they treat their employees, obviously doesn't appreciate their efforts, or alternatively, if they're better off working for the competition who will likely treat them more respectfully and professionally.

If there is a misunderstanding or dessension than the employee is most often taken advantage of due to their own fear and not given the opportunities or benefits to which they are legally entitled to (assuming of course that they're team players, hard working, professional, punctual, productive, efficient, and make their best conscious effort every moment of every work day).

As much as I dislike the leafs I dislike the bruins exponentially more... At least the leafs represent one of the few Canadian teams in the league, and eventhough it pisses me off that Darcy Tucker is producing alot more points than he ever did for us I wouldn't wish pain of suffering upon anyone else, especially not someone I've never even interacted with on a personal level.

From a humanitarian perspective you should keep him on payroll but perhaps transfer him to a different department where he wont hinder the company;s production. If he continues to work with the lack of efficiency, professioanlism, presentability, and business ethics one would expect from any office employee than his very being there not only counter-productive financially but reflects poorly on co-workers, the department to which he's assigned, and the business as a whole. If anything, keeping him employed would teach him how to improve his work habits and give him the opportunity to work towards self-improvement so morally you'd be doing the right thing by keeping him on staff. The fact that he wants to work and makes the effort instead of going on welfare or some other lazy alternative makes it hard to just fire the guy so I suggest demoting him to a position which would require him to work on simpler tasks without lowering his salery cause doing so wouldn't do anything except demotivate him further.

One of my old employers was out for lunch one day and a homeless man near place des arts asked him to spare some change so instead he gave him a business card and told him to show up at the office for his new job so he could get his life back on track. Needless to say he wasn't the most efficient or productive employee but he ended up working with us for over a month and was extremely appreciative of the opportunity given to him for no other reason than it was "the right thing to do". I suppose as a businessperson, keeping an employee on staff who's causing the company to lose money in the long run is definitely a bad decision but not all employers or supervisors are completely heartless which is why it's so difficult to fire some who's desperate for the job even if they're extremely incompetent.

Look at it this way.... If his job resta on your shoulders and you tell your boss to fire him it'll give you a guilty moral conscience, save money for the business, and potentially get you a promotion to a managerial position to replace the temp for taking a positive business initiative as opposed to the temp manager who's simply looking out for the employee as oppposed to looking out for the greated good of the business and all of its other employees as a whole. however you may not even get the promotion, increase in salery, or recognition from your boss for making the right business decision which, consequently, might make you feel as thouogh you made the wrong decision. On the other hand if you suggest keeping him on staff in his current (or different) position he may continue costing the company profit, which in turn could reflect a decrease in yours, and other employee saleries to compensate for the loses cause by "the weakest link" which obviously wouldn't be what most employers do but the possibility still remains. More likely would be the probability of your boss keeping him on staff as per your recommendation, therefore causing him, and or shareholders to lose out without any other employee salerie cutbacks which in turn wouldn't affect your financial situation ona a personal level. There's also a possiblity that your boss (not the temp manager) has already made his decision to keep ro let go of this employee and has simply asked your opinion as a "control question" as a test to see whether you're more naturally inclined to make moral or business judgements in such a situation.

Honestly, it's a very difficult judgment to make when other people's welfares are involved. Speaking from my own perspective, firing employees under any circumstances (except for theft or employee misconduct) would be a very difficult task for me which is possibly why I have yet to register and start running my own business. Inevitably, I suppose that every business owner needs to accept the fact that the capitalist system is designed to advantage of people and resources in order to accomplish personal game. Businesses simply don't profit or succeed without directly, or indirectly decreasing the quality of life for other people, animals, and the environment so realistically, progress in the business world is dependant on degeneration elsewhere or you'd have an imbalanced financial equation.

Oh wait a second, the United Stated National Debt is currently at 8.6+ Trillion dollars so I guess the equation already lacks the balance it requires to maintain it's ongoing stability anyways. I guess we're all gonna get fucked someday.

Believe it or not I've actually heard some people call him the "Indian Eddie Murphy" but to be honest I own 3 of his standup shows on dvd and eventhough he has some funny jokes and maneurisms I find he repeats alot of the same material so it gets slightly redundant after awhile.
