yeah downloading a tv show is making a digital copy of something already out there, you aren't paying for the right to watch it but it is not the same thing as taking that tv show and selling it on dvds and saying you made it yourself. | |

In this case, the person made a painting of the photo. Witch is, in a way, pirating media. Besides, how many artists do you know that can actually pay the rent with there art? I'm only at the second page and all ready this case has little relation to the case at hand. First, this is all happening in New York where peoples will sue you for just about anything. Second there is money to be made with paintings in New York. And third, the picture that was used as inspiration was taken by a professional photographer working through an agency.
I dont know what you can expect to receive from some painter that exposes in the windows of some boutique in mtl. How much do you figure that painting is worth in the first place? 500$ -800$ maybe. Thats small claims court. Its quite useless to get credits for a picture if you are not professional photographer. Now the question is, what kind of dick go's after some random noboby artist for royalty's? The answer is: Corporations, agency's, law firms. Who wants to go down that road, really? ...and the whole decontextualizing of images in this electronic age has nothing to do with this case. | |

1) There have been groundbreaking lawsuits in Montreal related to photography.. One of them is that you can't take a photo of anyone and publish it without their permission. That is a law based on a lawsuit that happened
2) Montreal is a real city with a big art scene and you can make money here. 3) There is no such thing as a 'professional' photographer. Anyone can make money and work taking photos. By your definition I am a professional photographer, since I take photos for a company and get paid for it. The case is higher profile but non-the-less is relevant. Also, according to Quebec law the person in the photo would have had to have given permission as well, where are they and what do they think about this? | |

the most i'd do is ask for a cut once the painting is sold.
i think the person in the photo/painting should be pissed/offended/chasing after the painter, if anyone. it's not like there's anything bad about the painting, it's nice, i don't see any problems with it. | |
