I was speaking to a police officer just a moment ago. I will call the municipal court tomorrow to get confirmation of what I learned today. But the police officer did point me in the right direction.

Basically : police officers can enforce a by-law amending a by-law regarding " peace and order " ( they can also enforce a law regarding " cleanliness of the public domain " ). This amendment modifies the article 7 of the chapter P-1 of the old municipal code.

The full article will be in my next post. I will give the reference so you will be able to check it out for yourselves.

About the fees, it reads :

For an individual :

100 to 1000$ for a first offence

150 $ to 2000$ for a second offence

So what Cyan said about her getting a 2000 $ fine is totally possible.

For a " company " that produces events ( " personne morale " ) it reads :

200$ to 2000$ for a first offence

300$ to 4000$ for a second offence

Bear in mind that the city of Montreal can prosecute offenders using two distinct " sets " of laws :

1 . The laws regarding the cleanliness of the public domain ( flyers on windshields, on the sidewalk, posters on walls, on public property in general ).

2. The laws regarding " peace and order in the public domain "

À moins qu'un règlement ne l'autorise, il est interdit de se tenir sur le domaine public ou sur la partie extérieure d'une propriété privée située à moins de 6 m du domaine public pour offrir, moyennant contrepartie, ses services ou ceux d'autrui à une personne, l'inviter à entrer ou se rendre à un lieu d'affaires, la photographier sans son consentement ou lui offrir de la photographier, lui remettre un coupon ou un certificat permettant d'obtenir un article, une marchandise ou autre service avec ou sans contrepartie, ou obtenir une clientèle pour soi-même ou pour autrui.

Quiconque contrevient à l'article 6 ou 7 commet une infraction et est passible :

1. s'il s'agit d'une personne physique :

a ) Pour une première infraction, d'une amende de 100 $ à 1000$
b ) Pour une récidive, d'une amende de 150 $ à 2000 $

2. S'il s'agit d'une corporation :
a ) Pour une première infraction, d'une amende de 200 $ à 2000 $
b ) Pour une récidive, d'une amende de 400 $ à 4000 $

So basically, this article of the civil code ( ie peace and order in the public domain ) states clearly that if you are standing on the public domain and trying to obtain a clientele, for whatever reason, it is an infraction and as an individual, it is possible for you to get a fine of 2000$.

Now

If the law regarding " cleanliness of the public domain " is enforced ( Règlement sur la propreté et sur la protection du domaine public et du mobilier urbain, R.R.V.M., c. P-12.2 ), they are a bit less agressive with the fines :

60 to 100 $ for a first infraction
100 to 300$ for a second infraction of same nature
300$ to 1000$ dollars for a third infraction

So if you got 5 or 6 fines and owe the city of montreal no more than 3000$, it is probable that, in your case, the law regarding " cleanliness of the public domain " was enforced, and not the other one.

Just an hypothesis : does that mean that the city of Montreal will aim to set " examples ", and give exemplary fines in order to discourage potential offenders ( promoters ) ??? I wonder.

In that insatance YOU are not soliciting a clientele, YOU are being solicited for the purposes of obtaining a flyer.

ya i heard about that fucking campaign. what a joke. ever since they announced it the city has been dirtier and more disgusting than ever. this summer was particularly bad. always garbage everywhere, the sidewalks running with garbage juice, garbage cans always filled to the point of overflow....piles of garbage bags obstructing the sidewalk, with most of the bags torn open and the contents strewn about by either bums or rodents...
its an abomination. trmeblay should be run the fuck out of town....
