I was under the impression that, for the first month that you work somewhere, your boss can fire you without giving you a reason, while after that it might get harder.
I found nothing about it on the normes du travail website. Turns out that they just have to give something like a week's notice, unless the guy did something serious.

Might as well wait a bit, although I.E. is calculated based on the time you've worked, so it might not get him all that much (better than a kick in the ass, though, for sure).
The risk is just to get in an unending cycle of "we can stand him just a little bit longer !"...

I like Phoenix's idea. Then again, depending on the field of business of your company, it might not be an option...

The field or industry doesn't affect employee rights unless otherwise specified in the contract (if any) at the time the employee is hired. Most people don't know their rights, don't care, or are easily intimidated by their employers and losing their pseudo-dependant jobs which is why alot of people get exploited, mistreated, overworked, or neglected when it comes to fringe benefits that the company offers to certain employees which they're usually, and should be entitled to (ie: company shares, medical beenfits, regular annual raises, overtime pay if applicable, vacation pay, paid sick days, etc.) I know alot of people, some of who are close friends of mine who are constantly being taken advantage of by their emplyers cause they feel trapped, don't understand their legal rights as an employee in the work force, or apathetically neglect to realize that they could work elsewhere doing the same thing for someone who wont mistreat, abuse, exploit them. Despite my continued efforts to help them build up the courage to stand up for themselves some of them are actually convinced that they're content with their jobs or don't have the confidence to confront their bosses with the alternative statement: "Unless you show more appreciation for my work and increase my wage accordingly, I'll be giving you my two week notice shortly and start working for your competition."

Speaking from my own experience employees should have a mutual respect and a mutual understanding with their employer regarding discourse or the terms and condition of the work being done. If such an accomidation cannot be made on the first day of work than one needs to ask themselves whether they're best off compromising their own financial, social, and psychological security working for someone who, reflective of the way they treat their employees, obviously doesn't appreciate their efforts, or alternatively, if they're better off working for the competition who will likely treat them more respectfully and professionally.

If there is a misunderstanding or dessension than the employee is most often taken advantage of due to their own fear and not given the opportunities or benefits to which they are legally entitled to (assuming of course that they're team players, hard working, professional, punctual, productive, efficient, and make their best conscious effort every moment of every work day).

I didn't mean that as to his rights, but as to the possibility of finding a place that suits him in the company.
For instance, I work in a brokerage firm, so I don't know that there would be a suitable place for him. Someone who works for a company which operates warehouses, though, might show more possibilities.
