Also you might want to look up for Copyrighting - not Copywriting. That's my job. Different stuff :)

Also, copyright is automatically given to the author of any creative content. You do not have to register it to enforce it, although doing so can help a lot in case a litigation occurs and you have to go through the whole process of calling on witness and the such to prove that you are the original author - creator of the work.

Trademark is when a name is registered by an entity (person or business) to act as a proprietary name to be used in conjunction with the entity's activities. A trademark can only be enforced withing the jurisdiction where it has been registered (Canadian trademark, US trademark, International trademark, etc) and prevent people from the same or related fields / occupations to use your trademark, potentially damaging your intellectual property rights, goodwill, or causing loss of profits.

From my understanding, due to the nature of the whole process, the paperwork required and the fees associated with it, most bands simply choose to setup a business entity (LLC) under the name of the band - or not at all.

Anything that is common usage or considered to be public domain can not be copyrighted or trademarked.

I think a band name is along the lines of a trademark where it's use predominate the protection itself and is contextualized, see trademark laws if this is actually the case.

its the office that do either the copyright or registered names.

they manage everything from songs , to registered patents.

if you go to the office downtown near renee levesque , they have lots of pamphlet on site.

they will answer better the questions you might have , esp. if introductionary, than trying to sort things out from the net.

but just like that , you might have to register the name at the BUIZNESS REGISTRAR of quebec,

then use this name to get a registered trade name.

i think you can copyright your bands material (track written, sleeve presentation , the format of the pieces sold) this can be copyright , but a name can only be registered as trade mark ..

anyways it goes with what dalida said , but readng their information they have on site will give you the actual time about what a copyright entirely covers and if you have to turn to just registering you band instead.

but copyrighting sleeves and cd case : is actually making a photocopy of your material offered in its complete form, helping you in court , declare you actually made the content on what date and all.

but imo its mostly a suggestion.
