This is what a car that gets in an accident at 30 km/h (The speed limit on Gouin, which he was "following") looks like Yeah, any passengers in that car TOTALLY needed to have the jaws of life used to pry open the car and ended up with broken ribs/in the hospital/dead. They totally did enough damage to uproot a tree, hit a car, and have enough momentum to end up in a livingroom. |

In regards to your first paragraph that mentions malice, I noticed your refrained from mentioning the example from your Wikipedia source which says: "An instance of this would be a defendant throwing a brick off a bridge, into vehicular traffic below." [ en.wikipedia.org ] Having taken several law classes, I highly doubt that the prosecutors will press charges for murder as that would break one of the fundamental pylons on which our judiciary institution relies on, which in this case would be breaking the trust in our legal system. Other than the obvious fact that the guy lost his lover... I think the majority of the population would find it very odd to press murder charges. Also, from what I recall about the Canadian criminal code, it is the prosecutor that has the burden of proof that the defendant did not take enough "precautions not to kill" when it comes to murder charges, not the other way around. If anything, the prosecutors would press charges for Causing death by criminal negligence (art. 219 (1) b) from Criminal Code) [ laws.justice.gc.ca ] But even there, we would need a majority based opinion of flesh-eating revenge-seeking activists, plus a heartless judge. So what does this come down to? Manslaughter, as much as this might piss you off, you just can't have the satisfaction of calling someone a murderer because you have the capacity to read black written characters off white paper. |
