I Got Arrested Today

For Being in a car with someone who had weed on them, I got charged with possetion cause they claimed I knew the weed was in the car even though it was not mine. Stayed in a holding area for 2 hours until they let me go... Grrr... Luckally it was in a small Ontario, so I'll never be going back there again ^_^. Stupid stuff...

in a holing cell for 2 hrs...wtf??? i was caught wif 14g last summer and i got a promise to appear, and then went home, no popo station..same for my friend who had budz too.

And btw smoking while driving is nooooo way comparable to drinking and driving...weed does not inebriate u like alcohol does.

Noah, if u have to go to court get a good lawyer..

You in file only for the OPP, so if I never goto ontario again there should not be any problem. Supposed to got court 5th of september at 9am, which is impossible since it's like 3 hours away from here. I doubt I'll show up which means if an OPP person ever catches me again for something, they will have to hold me, which I will laugh at since they will be spending lots of societies cash on me. Feed me and such. I can still travel wherever I want other then Ontario...

my boy got busted a few years back for smoking a joint on the bike path in brampton ontario...

he had half a joint in his possesion and had to go to court, do comunity service and a "rehab" program.

they even called his parents (something that they had no buisness doing since he was well over 18)

ontario is fuckin' stoopid.

Yah I have a feeling I'll have to go back to ontario a bunch of times if I decide to goto court. I would plea innocent though, although I'm sure they would have ways to make me guilty. I had nothing on me, they found stuff hidden in the car, but since the driver said he knew nothing of that being there, the law says it belongs to both of us? Who made up that law anyways. Anything in someones car should belong to the person of the car.

First off check the court summons notice you were given and make sure they didn't accidently send you to a municipal court... alot of cops make this mistake due to the fact that the law is very grey area and may no longer be considered a criminal offense within the next year or so...if they did mark down a municipal court then you're in the clear cause they don't have juristiction to charge you with a criminal offense and could have to transfer your file to a criminal court instead...however once you get there (the priliminary hearing) the safest thing to do is not to enter a plea whatsoever...if you don't enter a plea then they can't proceed beyond the priliminary hearing...the case will get delayed 2 or 3 times and then you'll have a better opportunity to get off on a double-jeopardy technicality since they'll have to mail you another summons which they can't do once you've already been given one based on arrest procedures. By entering an innocent plea you would be giving the court juristiction to charge you with something that you shouldn't even be charged with to begin with. A possession charge can only be given to someone if the substance is found on their person or on their property.... since it wasn't your car they have nothing on you so when you go to the priliminary hearing you can simply say that you dont understand the charge and refuse to enter a plea based on the fact that you were charged with another person's supposed crime. You also have the right to face your accuser...If the cop who busted you isnt at the priliminary hearing to testify and verify the charge that's being laid then you can simply get off based on that. Furthermore alot of evidence mysteriously gets lost when it comes to drug related incidences...If you did end up going to trial then it's the cop's word against yours so you just have to make sure your testimony is flawless, and unless he has a bag of chronic with your prints on it theres no way the court can prove that you were ever in possession of the substance in question...

I actually have no idea how much, it says less then 30g on the paper... I'm guessing about 1g... It's 100% not a criminal court, it's some court in a village of 80 people...

Morrisburg Court, 6 Fifth St West, Morrisburg, Ontario
Canada, Room 1

Anyways the case is at 9am, which means I would have to leave here at 6am to get there on time. Definately not happening. Whatever if I goto Ontario again, and they wanna make something from it, they can. It's a stupid charge.
