no law can overwrite the constitution, it is by definition the 'highest law in the land', it is from the constitution that all other laws gain legitimacy and validity, anything that can be said to go against the constitution is what's called 'ultra vires' or litterally beyond the reach of the constitution [ en.wikipedia.org ] and thus has no force in law. sofia mentioned the UN, this is where it gets much more complicated, and i don't really want to get into it... |

Even if the wire tap and torture scandals happened, we are still outraged and recognize them as illegal practices. the administration was forced by the supreme court in 2004 to put to trial the people guantanamo, if only in military courts, it's still a victory considering that the administration would probably have liked to be able to hold the detainees indefinitely. real patriots defend the constitution. |
