So I go to Vendome metro and I went up to the booth to buy 6 new tickets but the attendant wasn't there. Usually when that happens you just go through for free, but the turnstyle thing was closed. So I waited about 30 seconds, then I hear the metro comming...Im thinking the guy probably forgot to open the thing before he left for a break, so I jump the turnstyle and right away an undercover metro cop yells at me a proceeds to give me a $210 ticket.
It was like a sting operation or something.
I tried to explain and see if he could give me a warning, but he wasn't very understanding.

Anyways, now Im trying to decide if I should pay or contest.
any one ever contested a ticket from the STM?
any advice?

The metro cop told me that even if the guy left his post for 1 hour, it still dosn't give me the right to jump the turnstyle.
And then he says "When you go buy groceries, if there is no one at the cash, do you leave without paying?" I said, there is never no one at the cash and its not even the same thing!?...

The second after he caught me, I showed him 20$ and said I want to pay, but it wasn't an option.....and he's like "oh yeah, everyone wants to pay after they caught".

It would be nice to get a lawyer, but that'll probably cost me more than ticket.

No really man, even legal aid will field this one for you, dont pay for it, stand up for
what's right, the guy is obviously using that as an excuse, it's not like you would leave a
grocery fuckin store without paying, and you can't even compare the two, the stm are
notoriously lazy and terrible at their jobs, no wonder they use that against us to make more money.

Contest. Even if you have to contest yourself, fuck the lawyer.

Any "judge" that throws the "book" at you for this minor infraction is evil.

i don't want to be a contrarian here but i would suggest you just pay it and i will tell you why...you wont be pleading your case to a jury, it's gonna be a judge in a small claims court type thing, the judges in montreal have instructions to never side with you against the stm, you are just gonna waste your time trying to convince them that your right and it's not gonna one bit because they'll say you should have just waited till he came back...the most you can hope for in this situation is for them to reduce your fine by pleading poverty, you could just do community service it'll be about 15-20 hours...i know it sucks but it's just the way it is no matter how much it makes sense to you it wont make sense to them...

They prolly hear a hundred like that a week. I'm not so sure anymore, it might boil down to a pardon though
you never know Ian! If he comes in dressed well and states his case plain and simple, tbh , the judge might be sympathetic to his cause. I say give it a shot, it can't be all bad, they might reduce the fine. Who knows, I'm not a judge :p

the metro cops are totally un sympathetic, if they don't meet the quota a few months in a row they don't keep their job, as everyone knows their job is super cushy they get paid a lot per hour and don't do a whole lot, so when you say shit like "it's not fair" they don't even here you...if you jump the gates when the arrow isn't green and they catch you they are totally within their rights according to the metro rules to give you a fine, even if your card fucks up for some reason they can i still do it, i know it's shitty but it's just the way it is, do community service it'll be fun, just call the YMCA and ask for the legal aid dept, they'll meet you and set it up...

Problem is, in other cities, if there is no one at the booth, there are automated machines where you can buy tickets/tokens, not here.

I think Ian may be right, you don't have much ground to fight on, but fight it none the less. If you don't contest, you can only gripe on a rave message board that it is unfair., and obtain the sympathy of your peers.

At least if you try, and you lose, you still tried.
Guess it depends, if you have a day job that pays you 205$ for the day, suck it up and pay it....Frankly $200 is, to me anywa,y quite a chunk of cash. I a'int about to give away freely, ESPECIALLY if I feel I am in the right

a shit like that happened to me last year. my stm card (i'm a student) was expired, but only 3 days expired, and i just didn't have the time to do my new one. so i was at berri-uqam, cops asked me to show my card, i did, and the gave me a 210 $ ticket. i contested, and i won. because even if my card was expired, i had my metro-bus pass, i was a student, and i was younger than 25 y-o

1- I don't know if you go to college or university, but most school have an insurance include in your schooling fees and in 90% of the cases, that includes juridic services. If you don't have that kind of insurance, go to your students' association, they have councillors and contacts to help you in that kind of matter

2- I don't know if the metro cops are ruled by the same rules as the cops on the street, but there is a law (which I can't find right now, 'cuz I'm at work) that says that law inforcers cannot, on purpose, lead a trap in order to catch people committing infraction

3- I think that if you believe the situation is unfair (which personnally I think it is), you have to stand up and contest. Too many people juste bend down and say it's not worth the fight... and they just pay the fine. That kind of behaviour just encourages authorities to abuse their power, because they know that even if they're not in their rights, citizens won't contest because a) They represent the law and b) People just sit down and say it's not worth it

4- Just remember as well that if you contest and the cop doesn't show up to court (which happens 75% of the time 'cuz he's more useful catching other people commiting infractions and giving fines than being paid for a whole day waiting at the court, which doesn't bring money back at the end of it), you automatically win! :)

I don't follow this forum a lot, but if you want more infos, MP me... my mother used to be a notary and we have quite a bit of info that might answer some of your questions...
