MOM OF 2 GIRLS KILLED BY TRAIN WON'T FACE CRIMINAL CHARGES

RANCHO CUCAMONGA (AP) A 21yearold mother who says she was sleeping in
her apartment when her two daughters wandered into a commuter train's path
will not be charged despite blood tests that showed she had methamphetamine
in her system, officials said.

``We're not saying by this decision that this mother was a perfect mother
or that child care couldn't have been better that was not what we were
deciding,'' said San Bernardino County Chief Deputy District Attorney
Richard Maxwell.

Gross negligence had to be proven in order to charge Jackie Robles with a
felony count of child endangerment. Robles said she was sleeping when her
children left home and were struck by a Metrolink train Oct. 21.

The prosecutor said Thursday he could not prove the drug use contributed to
the deaths.

Prosecutors could not determine when Robles took the drugs or what effect
they had on her when her daughters left, district attorney's office
officials said in a statement.

``When (Robles was) examined immediately after the accident, the police
found no indication that would show she was under the influence of drugs,''
the district attorney's office reported.

Upland police, who drew public criticism for arresting Robles hours after
the accident, refused to comment on the district attorney's decision.

Robles was booked for investigation of child endangerment hours after the
deaths of her children, Alexes Elaine Robles, 3, and Deziree Andrea Soto,
21 months. She was released two days later.

Robles' 2monthold son was placed in the custody of her aunt after the
accident.

A fence was built between the railroad tracks and Robles' neighborhood
after the accident.
