Dewar said "sex was in the air" when he spared a man jail time by handing him a two-year conditional sentence last week instead and allowed him to remain free in the community.

During the sentencing, Dewar also commented on the way the woman was dressed and her actions the night she was forced to have sex by a man in the woods along a dark highway outside Thompson, Man., in 2006.

The man and a friend met the woman, who is now 25, and her girlfriend earlier that night outside a bar under what Dewar called "inviting circumstances."

The judge pointed out the victim and her friend were dressed in tube tops, no bras, and high heels and noted they were wearing plenty of makeup.

Dewar called the man a "clumsy Don Juan" who may have misunderstood what the victim wanted.

The sentence was delivered last week in Thompson.

"I feel like I'm a prisoner in my own home and I can't trust anyone," the victim said, adding she is extremely upset with Dewar's comments. "I don't think what he said was right. We were young and we were dressed classy. For him to say that the way we looked was basically asking for it is wrong and makes me angry."

The woman said she went into the bushes off the road to urinate and the man followed her in. "I wanted out of there and he wouldn't stop," she said about the attack, which left her covered in bruises. "I had to do what I had to do to survive because I was out there alone. I wanted to get away." She agrees with protesters who called for Dewar's resignation, saying, "I think he should not judge again." Then she added, "I think all rapists should be treated like a murderer because they take a part of your life."

if there was Old Testament style justice, I'd like to see that judge get locked up with some cellmates in general population of a maximum security pen. That way he could be on the receiving end of these "misunderstandings" and "inviting circumstances".

sure it could scar them for life. why is that so hard to believe? the way people deal with traumatic events varies, but a serious attack could easily lead to PTSD for the rest of their life.

Fuckin' Manitoba. Tack this one onto the list of reasons I got out of that place... as for whether it fucks up your life, I'd go with yes... it's a deeply humiliating and traumatizing event. Several very close friends have been through it, many of them required a lot of therapy... one of them, who actually went through with pressing charges against the posse involved in the attack on her and a friend, was subjected to YEARS of further harassment. I remember being over one night, maybe five years after the incident, and she was still keeping a log of threatening phone calls. At that time her court case still hadn't been resolved.

Aside from the being made to feel like a victim whilst pursuing justice, many of my friends dealt with immense feelings of shame related to what had happened... some of them felt guilt for even being in a situation where the crime could occur (and keep in mind, it's not always random strangers... in one case it was a neighbor, the friend who went to trial was assaulted by a group of guys she regularly bought pot from)...

Public castration is still a good idea. Guys who commit this kind of act should surrender their manhood, they are a disgrace to my gender... and an embarrassment to our species.

exactly as I thought, it made me think he date-raped, or tried to, a few times himself and as long as there's a sign that there might be possibility of sex then he can go on until he get punched in the balls. because that's what his dad or uncle told him: if a women really don't want you, she'll try to kick/punch your balls, because all real men know that a no is just a yes in disguise. @.@

Rape is simply sex. Women enjoy sex...so rape cannot be such a terrible physical ordeal. To suggest that rape, when conducted without violence, is a serious crime is like suggesting force-feeding a woman chocolate cake is a heinous offence.

i don't think women enjoy all sex from everyone at all times. If she isnt consenting, it will always imply violence to "force" the penetration... and when women are scared, they will "tight" their muscles and it will hurt to force anything inside. how would you like to have a dick entered in your anus without your consent? just imagine some fat old perv doing that to you... even if some men enjoy anal sex, i don't think you would appreciate it at that moment...

I'm a chick and I also tend to agree with suggesting to women not to dress like a tramp, there is a different between dressing in a revealing sexy way (classy) and dressing cheap. Also, there is a the part of behaviour, you can be dressed like a guy and act totally slutty, and you can be dressed like a tramp and be prude.

What is really disgusting and unforgivable about rape is that once the chick starts to fight you off (screams, pushes, kicks, cries wtv), if no wasn't clear enough, no matter the circumstances that lead to the act, a guy should be able to stop. "She was asking for it" is not an argument, even if he truly believe that, once the girl is panicking and screaming, it should turn him off, and if it doesn't he belong in therapy. (I am not including consensual B&D or wtv it's called). That's what always ticked me off about rape.

I am a psychology major, I can see/understand how one can get into such a situation, it's not being able to stop and reasoning through dishonourable behaviour that I don't get.

Rape does ruin lives, imagine making clear what you want and someone deciding that what you want doesn't matter, I would relate rape to being in a concentration camp, someone is violating the most intimate aspects that make you a person.

Do you think its a good thing when everytime you have sex you remember what happend the day you got rapped...that everytime your excited or something the only images you have in mind is that guy who forced hisself on you...how can you totally trust a man after being rapped by someone you knew.. or just met and seemed nice... sorry.... but it must ruine part of your life...

It was a simple question, not my commentary in any way...
but to go to an extreme, if I got ass raped, and I apologize for the imagery. other than trying to kill the person, etc... I don't think it would massively affect my life, like, bad shit, really bad shit happens to everyone and dwelling on it or applying those events to people in general is like a really bad choice to make.
As I am sure everyone has, I've been through some very strange sexual moments in my childhood, and all it taught me was that people are capable of just about anything, but it's a very personal and individual thing. I didn't apply those experiences to everyone or anyone else in fact.
I have a lot of trouble when some people apply their horrible experiences to everything that happens to them for the rest of their lives... like, way to make a bad situation worse. Truth is I know quite a few girls that got raped and obviously it was a defining moment for them, but they didn't get completely blown off the road of life; they don't mistrust everyone they see or curl up into a little ball and cry when sex is mentioned. They have a bad story and there's no excuse and the men should get castrated fo' shizzle, but life goes on and to some extent, you choose or choose not to dwell on those horrible horrible moments. Life is not ruined with any single moment, unless you are dead.
so i answered my own question I guess, it doesn't fuck everyone up for life. Heck, I think we're all fucked up already in our own ways...
BUT, saying that getting raped is worse then getting murdered or even seriously injured like stabbed or something, that I don't know.

Like... would a girl really rather get stabbed by a guy, then rapped by him? and if so, why is the rape so much more traumatizing... like are there emotions involved in rape, if so, isn't that weird? and if not, then how is it worse than getting beat up real bad. it's just physical violence no?

don't anyone dare think I'm supporting rape or anything, I'm just debating here. I personally don't see anything wrong with serious criminals getting the death penalty for things like rape, but the line is SO thin... let's be honest and admit that there are definitely some situations where a girl would sleep with a guy under suspicious circumstances and then claim it was rape for other reasons. There's too much 'personal choice' in 'some' circumsntances in how these things are labelled...
Also, the most common female sexual fantasy is what? rape.

* ANY FORM OF HARM DONE TO ANYONE UNDESERVED/UNCONSENTING IS WRONG. THAT is my view, so don't start calling me names or thinking I support rape...

also the politician who compared rape to force fed chocolate cake. I totally see the logic there... we're talking about being FORCE-FED something... so the situation is that you DON'T WANT to eat something and somebody is FORCING something down your throat. That would be pretty traumatizing and in a way fits a very general description of rape: getting something force into your body, not only without consent but against your will. that's rape.
